Governor Jan Brewer clearly has not read the Supreme Court opinion on SB 1070. She and Tea-Publicans in the Arizona legislature are running a propaganda offensive claiming "victory," when in fact SB 1070 is in serious trouble. The corporate "lamestream" media keeps saying that the "papers please" provision was "upheld." This is imprecise. The Court simply said it is not preempted by federal law at this preliminary stage.
The Court remanded the case back to the trial court for a trial on the merits. Arizona Courts may find the "papers please" provision is unconstitutional or violates federal law because it hinders the federal immigation law scheme outlined by the Court in this opinion. In short, the Court left this question to be resolved another day on an evidentiary trial record. The opinion today did not "uphold" the provision as constitutional. That issue remains to be decided.
I predict the trial court will issue an injunction when the case returns to the trial court, to remain in effect until the conclusion of the trial (and later on appeal).
John King of CNN was having none of Governor Jan Brewer's propaganda offensive. Brewer quickly devolved into speaking gibberish during this interview (video below the fold).

The Court practically invited lawsuits on equal protection grounds. I agree with your prediction. Meanwhile, every Latino citizen asked to "show their papers" will remember that when they vote in this election and ones to come.

In April, 2010, shortly after Governor Jan Brewer of Arizona signed a bill which she said was meant to curb illegal immigration, but in actual fact shockingly legalized racial profiling — in the process either purposely or inadvertently turning Arizona's more than 2 million legal Hispanic residents into a suspect class — Tucson Congressman Raul Grijalva called for an economic boycott of his state. In the ensuing months, conventions, tourists, and businesses looking for a hospitable environment in which to operate took heed, and Brewer's folly cost her state dearly. For his part, Grijalva's boycott made him a target of reactionaries in a state in which elected officials have in recent years been in mortal danger, and he and his staff have been the recipients of many threats, including death threats, over the past couple of years. We have interviewed Congressman Grijalva several different times since the spring of 2010, and we spoke to him on Monday afternoon, just after the Supreme Court severely weakened SB 1070.
